Part B Procedural Safeguards
Upon initial consideration (referral/evaluation) of the provision of special education services, upon parental request, upon the first occurrence of the filing of a complaint or due process hearing and when a decision has been made to take a disciplinary action that constitutes a change of placement, parents must receive:

Note: Districts may adopt a policy of practice of providing additional information or explanation to parents. The legal minimum is to provide the document and provide the parents with a resource to get further information and support (PTI and Nebraska Advocacy).
PART C Procedural Safeguards
A copy of the Procedural Safeguards Notice must be provided to parents one (1) time per year. A copy must also be provided:
- upon request by the parent;
- upon initial referral or parental request for evaluation;
- upon the first occurrence of the filing of a state complaint and the first occurrence of filing a special education due process complaint; and
- in accordance with discipline procedures
